General Donation Terms (GDT)

Purpose and Capacity

These General Donation Terms (hereinafter the “GDT”) govern donations made online for the benefit of the European Fire Prevention & Rural Preservation Organization (EFPRP), a French non-profit association governed by the French Law of July 1, 1901, registered under RNA W313039674 and SIREN 934482746.

Any person making a donation declares that they are of legal age and have the legal capacity to make such a donation.

By validating a donation, the donor acknowledges having read and understood these GDT and agrees to be bound by them without reservation.

Nature of the Donation

A donation is a voluntary payment made without any direct consideration or equivalent benefit being provided to the donor.

EFPRP may receive manual donations (dons manuels) in accordance with applicable French law governing registered associations.

The amount of the donation is freely determined by the donor, subject to any technical or regulatory limitations applicable to the payment method used.

Allocation of Funds

Where possible, donations are allocated to the specific campaign or project selected by the donor at the time of the donation (for example, Gironde Restoration).

Where the donor does not select a specific campaign, the funds are allocated to EFPRP’s general activities in accordance with its statutory purpose.

If the financial objective of a campaign has been reached, if the project is cancelled, becomes impossible to carry out, or if circumstances make its implementation materially or legally impossible, EFPRP may allocate all or part of the funds collected to another activity pursuing a similar objective or falling within its statutory missions.

Any such reallocation shall be carried out in accordance with the purpose of the donation and applicable law.


Donation Validation and Payment

A donation is considered completed once the payment has been validated by the relevant payment service provider.

Payments may be processed by a payment service provider or specialized platform, including Yapla and/or Stripe, depending on the payment method selected and the options available at the time of the donation.

EFPRP does not retain complete payment card or banking information where such information is processed directly by the relevant payment service provider.

Payment confirmation may be sent to the donor by email.


Irrevocability and No Refunds

Subject to any mandatory provisions of applicable law, a donation that has been duly made and effectively transferred to EFPRP constitutes a final and irrevocable contribution and may not be cancelled or refunded solely at the donor’s request.

This provision does not prevent refunds resulting from a technical error, fraudulent payment, unauthorized transaction, duplicate payment, or any other circumstance in which the return of funds is legally or technically required.


Tax Receipts

Where EFPRP meets the legal requirements allowing donations made to it to qualify for a tax reduction, donations may benefit from the tax regime provided for, in particular, under Article 200 of the French General Tax Code (Code général des impôts), subject to the conditions applicable to the donor and the donation.

For individuals, the standard regime generally provides for a tax reduction equal to 66% of the amount donated, subject to the limits established by applicable tax legislation. Specific tax regimes may apply in certain circumstances.

The donor remains responsible for the accuracy of the information provided and for their individual tax situation.

Where a tax receipt is applicable, it shall be issued in accordance with the tax rules in force and transmitted to the donor by email or by any other appropriate means.

The issuance of a tax receipt does not constitute a guarantee that the donor will actually be entitled to claim the corresponding tax reduction. Such entitlement is determined by the tax authorities in accordance with the donor’s individual circumstances.


Donation and Consideration

The donor acknowledges that their payment is made freely and without receiving any equivalent direct or indirect consideration from EFPRP.

The absence of consideration is, in particular, one of the conditions applicable to donations that qualify for a tax reduction under French tax law.


Personal Data Protection (GDPR)

In connection with the management of donations, EFPRP may collect certain personal data necessary in particular for:

  • identifying the donor;

  • processing and monitoring the donation;

  • issuing and retaining receipts and tax documents;

  • administrative and accounting management;

  • preventing fraud and unauthorized payments; and

  • where applicable, managing the relationship with the donor.

Personal data may be processed by EFPRP and by the technical service providers necessary for the operation of the donation service, including payment service providers and Yapla and/or Stripe, within the scope of their respective functions.

Personal data is retained for the periods necessary to fulfill the purposes for which it was collected and, where applicable, for the periods required by legal and accounting obligations.

In accordance with applicable personal data protection legislation, including the General Data Protection Regulation (GDPR), donors have, subject to the conditions and limitations provided by applicable law, rights relating to their personal data, including rights of access, rectification, erasure, restriction of processing and, where applicable, objection to processing.

Transaction Security

EFPRP implements technical and organizational measures designed to ensure the security of information processed in connection with donations.

Payment information may be processed directly by payment service providers in accordance with their own terms of service and privacy policies.

EFPRP shall not be held responsible for temporary interruptions of the payment service resulting from circumstances beyond its reasonable control or from a failure of a third-party service provider.


Accuracy of Information Provided

The donor undertakes to provide accurate, complete, and up-to-date information where such information is necessary to process the donation or issue a tax receipt.

Any error in the information provided, particularly concerning the donor’s identity or contact details, may result in a delay or inability to correctly issue certain documents or receipts.


Fraud Prevention and Unauthorized Payments

EFPRP reserves the right to verify or temporarily suspend the processing of a transaction where circumstances indicate potential fraud, unauthorized use of a payment method, or a technical anomaly.

Where a payment is subsequently identified as fraudulent or unauthorized, EFPRP may take any necessary action, including in cooperation with the relevant payment service provider.


Liability

EFPRP endeavors to ensure the availability and proper functioning of its online donation service.

However, EFPRP shall not be held liable for interruptions, delays, or malfunctions attributable to circumstances beyond its reasonable control, including telecommunications networks, hosting services, payment service providers, or any other third-party service.


Amendments to these GDT

EFPRP may amend these GDT where necessary, including as a result of changes in legislation, regulations, technology, or organizational arrangements.

The applicable version shall be the version published on EFPRP’s website at www.efprp.org/donation-policy at the time the donation is made. The version of these GDT published on the Yapla platform shall be updated concurrently with any amendment to these terms.


Applicable Law

These GDT are governed by French law.

Any dispute relating to their interpretation or performance shall, in the absence of an amicable resolution, be submitted to the competent courts in accordance with the applicable rules of jurisdiction.
