General Terms & Conditions of Sale (GTCS)

Preamble & Identification of the Seller


The website www.efprp.org (hereinafter the "Site") and its online shop are operated by: European Fire Prevention & Rural Preservation Organization (EFPRP)

These General Terms and Conditions of Sale (GTCS) govern, without restriction or reservation, all sales concluded between the EFPRP (the "Seller") and any non-professional buyer (the "Client") wishing to acquire the products offered for sale on the Site.


Products & Availability

Description: The products offered for sale are those described on the Site on the day the Client consults the Site. The EFPRP takes the greatest care in the presentation and description of these products to provide the Client with the best possible information.

Availability: Product offers are valid as long as they are visible on the Site, within the limits of available stock. In the event of unavailability of a product after placing an order, the Client will be informed by email. The order will be automatically cancelled, and no bank debit will be made (or a full refund will be issued). 


Pricing

Taxes: Prices include Value Added Tax (VAT) applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.

Shipping Costs: Prices do not include processing, shipping, and transport costs, which are calculated strictly before the validation of the order.

Customs Duties: For orders shipped outside the European Union, the Client is the importer of the products concerned. Customs duties, local taxes, or import duties may be payable. These rights and sums are not within the purview of the EFPRP. They are strictly the responsibility of the Client.


Order process

Selection: The Client selects the initial product, then, will be prompted to a Stripe payment page, where the client will be able to add complementary products to the purchase.

Review: The Client checks the total price, and may make changes, additions or substractions of items.

Identification: The Client logs in or creates an account and provides delivery details (handled by Stripe)

Acceptance: The Client confirms their understanding and acceptance of these GTCS.

Payment: The Client validates the order by clicking on the "Pay" button.

Confirmation: The contract is formed when the EFPRP sends an acknowledgement of receipt of the order by email. The EFPRP reserves the right to cancel any order from a Client with whom there is a dispute over payment of a previous order.


Payment Terms

Payment is due immediately upon ordering.

  • Methods: Settlement is made by secure payment via Credit Card (Visa, MasterCard) or other approved payment gateways indicated on the Site (Stripe).

  • Security: The Site uses a secured SSL encryption system. The EFPRP does not store the Client's banking data, unless authorized to do so. Deletion can always be requested for any payment-related information.


Delivery

Address: Products are delivered to the delivery address indicated by the Client during the ordering process. The Client is responsible for the accuracy of the information provided.

Delays: Delivery times indicated on the Site are estimates and correspond to average processing and delivery times. The EFPRP cannot be held responsible for consequences due to a delay in transmission by the carrier.

Transfer of Risk: Risk of loss or damage to the products passes to the Client solely at the moment the Client (or a third party designated by them) takes physical possession of the products.


Right of Withdrawal (14 days)

In accordance with Article L.221-18 of the French Consumer Code, the Client has a period of fourteen (14) days from the receipt of the product to exercise their right of withdrawal without having to justify reasons or pay a penalty.

  • Exercise of Right: The Client must inform the EFPRP of their decision to withdraw by sending a clear statement (letter or email) to the Seller's contact address.

  • Returns: The Client must return the goods no later than 14 days following the communication of their decision to withdraw.

  • Cost: Direct return costs are borne by the Client.

  • Refund: The EFPRP will refund the Client for all payments received (excluding return costs) within 14 days of recovering the goods.

  • Exception: This right does not apply to personalized items or goods which are liable to deteriorate or expire rapidly.


Legal Warranties

Regardless of the country of the Client, the EFPRP remains liable for legal warranties under French Law:

  • Guarantee of Conformity (Art. L.217-4 et seq. Consumer Code): If the product is unfit for the usual expected use.

  • Guarantee against Hidden Defects (Art. 1641 et seq. Civil Code): If a hidden defect renders the product unfit for use. To initiate a warranty claim, the Client must contact support.


Donations

This section applies if the user utilizes the "Donate" feature of the Site.

  • Nature: A donation is a gratuitous transfer of funds to support the EFPRP's non-profit mission.

  • Irrevocability: Donations are immediate and irrevocable. They are not subject to the Right of Withdrawal applicable to sales.

  • Receipts: Tax receipts will be issued in accordance with French fiscal regulations.


Limitation of Liability

The EFPRP cannot be held liable for the non-performance of the contract in the event of stock shortage, unavailability of the product, force majeure, disruption, or total or partial strike, particularly of postal services and means of transport or communications.


Data Protection

The personal data collected is necessary for the processing of the order and the issuance of invoices. It may be communicated to the EFPRP's partners responsible for the execution, processing, management, and payment of orders. The Client has a right of permanent access, modification, rectification, and opposition with regard to information concerning them.


Language Supremacy Clause

The Client acknowledges and agrees that the official language of these General Terms and Conditions of Sale is English. Although the EFPRP is a French entity, the international nature of its mission and audience necessitates the use of English as the standard medium of contract. In the event of any discrepancy between a translation of this text and the English version, the English version shall prevail.


Applicable Law & Jurisdiction

These General Terms and Conditions of Sale strictly legally governed by French Law. In the absence of an amicable resolution, any dispute relating to the interpretation, validity, or execution of these GTCS shall be submitted to the exclusive jurisdiction of the competent courts of Toulouse, France.
